Welcome to Beauty Flex! The terms “we”, “us” and “our” refer to Beauty Flex. Beauty Flex operates this store and website, including all related information, content, features, tools, products and services in order to provide you (the “Services”) with a curated shopping experience. Beauty Flex is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service (the “Terms”), together with the policies referenced herein, describe your rights and responsibilities when you use the Services. By visiting, interacting with or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, please do not use or access our Services.

When you place an order, you make an offer to purchase. Beauty Flex may accept or decline your order at its discretion. Your order is accepted only when we confirm acceptance and process your payment. Please review your order carefully before submitting; we may be unable to accommodate cancellations after acceptance. If we do not accept, make a change to, or cancel an order, we will attempt to notify you using the email, billing address, and/or phone number provided.

You represent and warrant that your purchases are for personal or household use and not for commercial resale or export.

Section 4 – Prices and Billing

Prices, discounts and promotions are subject to change without notice. The price charged will be the price in effect at the time the order is placed and will appear in your order confirmation. Unless expressly stated, posted prices exclude taxes, shipping, handling, customs and import charges.

Prices in our online stores may differ from prices in physical or third-party stores. Promotions may have separate terms; if a conflict exists, promotional terms control.

You agree to provide current, complete and accurate purchase, payment and account information and to promptly update your details so we can complete transactions and contact you as needed. You represent and warrant that (i) your payment information is true, correct and complete, (ii) you are authorized to use the payment method, (iii) charges will be honored by your provider, and (iv) you will pay charges at posted prices, including shipping/handling and applicable taxes.

Section 5 – Shipping and Delivery

All delivery times are estimates only and are not guaranteed. We are not liable for delays caused by carriers, customs, or events outside our control. Once we transfer products to the carrier, title and risk of loss pass to you.

The Services (including trademarks, brands, text, images, graphics, video, audio, and their selection and arrangement) are owned by Beauty Flex, its affiliates or licensors and are protected by applicable intellectual property laws. You may use the Services for personal, non-commercial use only. Except as expressly permitted, you may not reproduce, distribute, modify, create derivative works of, publicly display or perform, republish, download, store, or transmit any material without prior written consent.

Beauty Flex names, logos, product and service names, designs and slogans are trademarks of Beauty Flex or its affiliates or licensors. Shopify names and marks are trademarks of Shopify. All other marks are the property of their respective owners.

Section 7 – Optional Tools

You may be provided access to third-party tools “as is” and “as available,” without warranties or endorsements. Your use of such tools is at your own risk and subject to the third party’s terms. New features offered in the future shall also be deemed part of the Services and subject to these Terms.

Section 8 – Third-Party Links

The Services may include materials or links to third-party websites. We do not control or guarantee their content or accuracy and are not liable for any harms related to third-party sites or purchases. Review third-party policies before engaging in transactions. Section 9 – Relationship with Shopify

Note: This section reflects Shopify’s relationship with your store. Beauty Flex is powered by Shopify. However, any sales and purchases you make are with Beauty Flex directly. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of sales between you and Beauty Flex. You expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Beauty Flex.

Section 10 – Privacy Policy

All personal information we collect is subject to our Privacy Policy, and certain information may be subject to Shopify’s Privacy Policy. Because the Services are hosted by Shopify, Shopify collects and processes certain personal information to provide and improve the Services. Section 11 – Feedback

If you submit ideas, suggestions, reviews, or other content (“Feedback”), you grant us a perpetual, worldwide, sublicensable, royalty-free license to use, reproduce, modify, publish, distribute and display such Feedback for any purpose. Medical Device Disclaimer: Products sold by Beauty Flex (including aesthetic and medical-grade devices) are intended for professional use by trained operators or as otherwise specified in the product documentation. Results vary based on skin type, condition and usage. Beauty Flex is not liable for misuse, untrained operation, or off-label applications.

Section 16 – Limitation of Liability

To the fullest extent permitted by law, in no case shall Beauty Flex, our partners, directors, officers, employees, affiliates, agents, contractors, service providers or licensors (or Shopify and its affiliates) be liable for any indirect, incidental, punitive, special, or consequential damages, or any lost profits, revenues, savings, data, replacement costs or similar damages, whether in contract, tort, strict liability or otherwise, arising from your use of the Services or any products, even if advised of the possibility.

Section 17 – Indemnification

You agree to indemnify, defend and hold harmless Beauty Flex, Shopify and our respective affiliates, partners, officers, directors, employees, agents, contractors, licensors and service providers from any claims, liabilities, damages, losses and expenses (including reasonable attorneys’ fees) arising out of your breach of these Terms, violation of law or rights of others, or your use of the Services. We may control the defense and settlement of indemnified claims.

Section 18 – Severability

If any provision of these Terms is unlawful, void or unenforceable, that provision shall be enforced to the maximum extent permitted and the remainder will remain in full force and effect.

Section 19 – Waiver; Entire Agreement

Failure to exercise any right shall not constitute a waiver. These Terms, together with policies posted on the site, constitute the entire agreement between you and us regarding the Services and supersede prior agreements and communications.

These Terms and any related agreements are governed by the laws of India. You and Beauty Flex agree to the exclusive jurisdiction and venue of the courts located in Mumbai, Maharashtra, India.
